If you do not agree with these Terms, please do not use the Site.

Information on the Site is intended primarily for businesses, professionals, consultants, organizations, and other persons interested in improving their digital presence.
2. Acceptance of These Terms
By accessing, browsing, interacting with, or submitting information through the Site, you acknowledge that you have read and understood these Terms.
Your use of the Site constitutes acceptance of these Terms where such acceptance is recognized under applicable law.
If you use the Site on behalf of a business, company, partnership, organization, or other entity, you represent that you have authority to provide information on behalf of that entity and, where applicable, to bind that entity to agreements you separately enter into.
Merely visiting the Site does not itself create a paid service relationship.
3. Eligibility and Legal Capacity
The Site is intended for persons capable of using business websites and making business enquiries lawfully.
If you enter into a paid agreement for services, you must be legally competent to enter into that agreement under applicable law.
If you are acting for a business or organization, you are responsible for ensuring that you have appropriate authority to act on its behalf.
The Site is not directed toward children.
4. Website Use Does Not Automatically Create a Client Relationship
Using the Site, reading its content, contacting me, submitting a form, requesting a Free AI Visibility Audit, sending a WhatsApp message, or making a telephone enquiry does not automatically create a client, consultant, agency, fiduciary, or professional-services relationship.
A paid service relationship will arise only when there is a clear agreement between us.
Depending on the project, this may include:
- an accepted proposal;
- statement of work;
- service agreement;
- written scope confirmation;
- invoice or payment request;
- agreed payment;
- or another clear written acceptance of the applicable project terms.
Until such an agreement exists, neither party should assume that a project has been formally commissioned.
5. Free AI Visibility Audit
The Free AI Visibility Audit is an introductory business diagnostic.
It may assess matters such as:
- business clarity;
- website information;
- Google/local presence;
- AI-answer readiness;
- authority signals;
- structured business information;
- enquiry paths; and
- other relevant aspects of online visibility.
The audit is intended to identify potential issues and opportunities.
It is not:
- an official Google audit;
- an official OpenAI or ChatGPT audit;
- an official Gemini audit;
- an official Grok audit;
- a guaranteed SEO ranking assessment;
- a guarantee of AI inclusion;
- a guarantee of recommendation by any platform;
- a legal, financial, accounting, or regulated professional opinion; or
- a guarantee that implementing any recommendation will produce a particular commercial result.
The audit may use categories such as:
Strong
Needs Improvement
Weak
These are independent diagnostic observations and are not official scores issued by Google, OpenAI, Microsoft, xAI, Meta, or another search or AI platform.
6. Information Used in an Audit
When you request an audit, I may review information you submit as well as publicly available information relating to your business.
This may include:
- your website;
- Google Business Profile;
- public search results;
- business directories;
- publicly accessible social profiles;
- publicly visible reviews;
- business listings;
- public website metadata;
- search-visible business information; and
- other relevant public sources.
An audit reflects information reasonably available at or around the time of review.
Online information can change frequently.
Accordingly, an audit should not be treated as a permanent or exhaustive description of a business's digital presence.
7. Accuracy of Information You Provide
You are responsible for the accuracy of information you provide through the Site.
You agree not to knowingly submit:
- materially false information;
- misleading business information;
- another person's contact information without appropriate authority;
- fraudulent enquiries;
- malicious URLs;
- unlawful material;
- confidential information you are not authorized to disclose;
- patient-identifiable medical information;
- payment-card information;
- passwords or authentication credentials; or
- other information that should not reasonably be submitted through a business enquiry form.
If you submit information on behalf of another business or organization, you represent that you have appropriate authority to do so.
8. Privacy and Personal Information
Personal information submitted through the Site is handled in accordance with the Site's Privacy Policy.
The Privacy Policy explains matters including:
- information collected;
- purposes of collection;
- managed Site storage;
- security measures;
- retention;
- privacy requests;
- third-party services; and
- relevant data-handling practices.
The Privacy Policy forms an important part of the Site's overall terms and notices.
You should review it before submitting personal information.
9. Site Hosting
The Site is currently built and hosted using ChatGPT Sites, provided by OpenAI.
OpenAI provides infrastructure used to host and operate the Site but is not the provider of the professional services offered by Arunaksha Sarkar through this Site.
Any professional-service agreement you enter into with Arunaksha Sarkar is between you and Arunaksha Sarkar unless a separate written agreement expressly states otherwise.
The Site may be affected by the availability, technical limitations, security controls, policies, or functionality of its hosting infrastructure.
10. AI Visibility — No Guaranteed Platform Outcome
AI Visibility work is intended to improve the quality, clarity, consistency, accessibility, usefulness, structure, and authority of information relating to a business.
No service offered through this Site can guarantee that:
- ChatGPT will mention your business;
- Gemini will mention your business;
- Grok will mention your business;
- Google AI features will mention your business;
- another AI system will recommend your business;
- an AI-generated answer will cite your website;
- a search engine will rank your website at a particular position;
- your Google Business Profile will achieve a particular ranking;
- your website will receive a specific volume of traffic;
- you will receive a specific number of enquiries; or
- visibility improvements will result in a particular amount of revenue.
Search engines, AI systems, recommendation systems, directories, and third-party platforms use their own technologies, algorithms, data sources, policies, and ranking or response-generation processes.
Those systems are outside my control.
11. Search Engine and SEO Results
SEO and search visibility are influenced by numerous factors.
These may include:
- competition;
- website quality;
- business reputation;
- domain history;
- content quality;
- relevance;
- location;
- third-party references;
- reviews;
- technical performance;
- platform policies;
- algorithm changes; and
- factors that may not be publicly disclosed.
Any SEO-related service or discussion should therefore be understood as an effort to improve the underlying conditions for visibility rather than a promise of a particular ranking.
12. Illustrative AI and Search Visuals
The Site may use diagrams, screenshots, mockups, examples, generated images, conceptual chat interfaces, or other illustrations to explain how AI-assisted search and business discovery may work.
Unless explicitly identified as a documented real-world result, these materials are illustrative examples.
For example, an image showing a business appearing in a simulated ChatGPT, Gemini, Grok, Google, or other AI/search conversation should not be interpreted as evidence that the named platform has actually recommended that business.
Illustrative examples are used to explain concepts, user journeys, or possible outcomes.
Real results, where presented, should be clearly identified and supported by appropriate evidence.
13. Third-Party Names, Trademarks, and Platforms
The Site may refer to third-party products, companies, services, or platforms, including names such as:
- Google;
- Google Search;
- Google Maps;
- Google Business Profile;
- ChatGPT;
- OpenAI;
- Gemini;
- Grok;
- WhatsApp;
- and other platforms relevant to search, AI, websites, or digital business.
All third-party trademarks, names, logos, products, and services remain the property of their respective owners.
References to them are made for identification, comparison, education, commentary, interoperability, or explanation.
Unless expressly stated otherwise, the Site and services offered by Arunaksha Sarkar are independent and are not sponsored, endorsed, certified, authorized, or operated by these third-party companies.
14. No Professional Advice Outside the Agreed Service
General content on the Site is provided for business and informational purposes.
Nothing on the Site should be interpreted as:
- legal advice;
- tax advice;
- accounting advice;
- financial advice;
- investment advice;
- medical advice;
- cybersecurity certification;
- regulatory compliance advice; or
- another regulated professional opinion,
unless such service is expressly provided by an appropriately qualified professional under a separate written agreement.
You should seek appropriate professional advice where necessary.
15. Service Descriptions
The Site may describe available or proposed professional services.
Examples may include:
AI Business Launch System
A package intended for businesses requiring a stronger website and digital visibility foundation.
AI Visibility Upgrade
A service intended for businesses whose existing website may be usable but whose digital visibility, business clarity, or search/AI readiness can be improved.
AI Visibility Monitoring
An ongoing monitoring or optimization service that may be offered after initial implementation.
Descriptions on the Site provide a general overview.
The specific scope for an individual client will be determined by the accepted proposal, statement of work, service agreement, or other written project confirmation.
16. Website Prices
The Site may display prices, starting prices, founding-client prices, package prices, or indicative pricing.
Examples may currently include amounts such as:
- ₹16,999 for a founding version of the AI Business Launch System;
- starting at ₹6,999 for certain AI Visibility Upgrade work; and
- starting at ₹3,999/month for certain monitoring services.
Unless expressly stated otherwise in an accepted written agreement, prices displayed on the Site:
- are informational;
- may depend on scope;
- may change;
- may apply only to particular offers or eligibility conditions;
- may not include third-party expenses;
- may not include taxes or statutory charges where applicable; and
- do not automatically constitute a final quotation for every project.
Your final project price will be confirmed before paid work begins.
17. Founding Offers and Capacity Statements
The Site may display limited-capacity or founding-client offers.
For example, the Site may state that I accept a maximum number of new businesses during a particular period.
Such capacity limitations are intended to reflect genuine operational constraints.
Availability may change.
A visitor is not guaranteed a project slot merely because a particular capacity statement is visible on the Site.
A project is accepted only after scope, availability, and commercial terms are confirmed.
18. Proposals and Quotations
Any proposal, quotation, scope document, invoice, project plan, or statement of work issued following an enquiry may contain additional or different terms.
Where a specific written service agreement or accepted proposal conflicts with these general Site Terms in relation to a paid project, the more specific project agreement will ordinarily control that project to the extent of the conflict.
These Site Terms primarily govern use of the Site.
Separate Service Terms may also apply to paid services.
19. Payments
The Site currently does not require visitors to provide payment-card information through the Free AI Visibility Audit.
If you become a client, payment arrangements will be communicated separately.
Payments may be accepted through methods agreed for the relevant project.
Do not submit:
- credit or debit card numbers;
- CVV codes;
- UPI PINs;
- banking passwords;
- OTPs; or
- other payment authentication credentials
through the Free AI Visibility Audit or ordinary Site enquiry forms.
If a third-party payment processor is introduced in the future, that provider's own terms and privacy practices may apply.
20. Refunds and Cancellations
Refunds, deposits, project cancellation, and termination of paid services are governed by:
- the applicable proposal or service agreement;
- the Site's Refund & Cancellation Policy where applicable;
- any specific terms disclosed before payment; and
- applicable law.
Submitting a Free AI Visibility Audit does not create a payment obligation.
Nothing in these Terms removes consumer rights or remedies that cannot lawfully be excluded.
21. Intellectual Property
Unless otherwise stated, the Site and its original content may include intellectual property owned by or lawfully used by Arunaksha Sarkar.
This may include:
- written copy;
- branding;
- logos;
- original graphics;
- layouts;
- frameworks;
- audit structures;
- diagrams;
- service descriptions;
- original photographs;
- code or design elements where rights are held;
- reports;
- downloadable material; and
- other original content.
Third-party names, trademarks, images, software, interfaces, and other third-party materials remain subject to their respective owners' rights.
No provision of these Terms transfers ownership of the Site's intellectual property to you.
22. Limited Permission to Use Site Content
You may access and use the Site for legitimate personal or business informational purposes.
You may:
- view public Site content;
- share ordinary links to public pages;
- print or save reasonable portions for your own reference; and
- use information provided specifically to you in accordance with any applicable service agreement.
You may not, without permission:
- reproduce substantial portions of the Site for commercial resale;
- republish original Site content as your own;
- remove copyright or attribution notices;
- copy proprietary frameworks for resale;
- falsely imply ownership or authorship;
- use Site branding to impersonate Arunaksha Sarkar;
- distribute paid or confidential deliverables to unauthorized parties; or
- use Site content in a manner that infringes applicable intellectual-property rights.
23. Information and Materials You Submit
You retain whatever rights you lawfully hold in information you submit through the Site.
By submitting business information for an audit or enquiry, you give me permission to use that information only as reasonably necessary to:
- receive and store the submission;
- respond to you;
- evaluate your business;
- prepare the requested audit;
- prepare a proposal;
- provide an agreed service;
- maintain relevant business records;
- protect the Site from misuse; and
- perform other uses described in the Privacy Policy or separately agreed with you.
Submitting information does not transfer ownership of your business, trademarks, website, or proprietary materials to me.
24. Confidential Information
The Free AI Visibility Audit is not designed as a secure channel for highly confidential business information.
Do not submit trade secrets, passwords, authentication credentials, patient data, financial credentials, private customer records, or other unnecessary confidential material through the public form.
If a project later requires confidential information, appropriate arrangements can be made separately.
The treatment of confidential information during paid client engagements may be governed by separate Service Terms, a service agreement, or a confidentiality agreement where appropriate.
25. Prohibited Use
You may not use the Site:
- for unlawful purposes;
- to submit fraudulent or intentionally misleading enquiries;
- to impersonate another person or business;
- to interfere with Site security;
- to attempt unauthorized database or administrative access;
- to bypass rate limits or access controls;
- to inject malicious code;
- to distribute malware;
- to conduct phishing;
- to probe for vulnerabilities without authorization;
- to overload or intentionally disrupt Site infrastructure;
- to submit spam through Site forms;
- to collect personal information unlawfully;
- to infringe intellectual-property rights;
- to transmit material you have no right to provide; or
- in another manner that violates applicable law.
Ordinary access by legitimate search engines and other permitted indexing systems is not prohibited merely because it is automated.
26. Security
Reasonable measures are used to protect the Site and information submitted through it.
However, no website or internet-based system can guarantee complete security.
You are responsible for using reasonable care when accessing websites and submitting information online.
If you become aware of a potential security issue affecting this Site, please report it responsibly instead of attempting to exploit it.
27. Website Availability
I aim to keep the Site reasonably available, but uninterrupted availability is not guaranteed.
The Site may become temporarily unavailable due to:
- maintenance;
- deployment;
- hosting issues;
- software errors;
- network failures;
- security incidents;
- third-party outages;
- platform restrictions;
- force majeure events; or
- other circumstances outside reasonable control.
No guarantee is made that every feature will always remain available.
28. Changes to the Site
I may modify, redesign, update, remove, suspend, or add Site content or functionality from time to time.
This may include changes to:
- services;
- offers;
- prices;
- content;
- eligibility;
- forms;
- availability;
- Site architecture;
- hosting;
- features; and
- policies.
Where a change affects an already accepted paid project, the applicable project agreement will govern that engagement.
29. External Links
The Site may contain links to third-party websites or services.
These may include:
- Google Business Profiles;
- WhatsApp;
- social networks;
- portfolio websites;
- client websites;
- search engines;
- AI platforms;
- booking services;
- or other external resources.
External links are provided for convenience, reference, or functionality.
I do not control independent third-party websites and am not responsible for their content, availability, security, policies, or practices.
You use third-party services subject to their own terms.
30. Portfolio and Project References
The Site may display examples of past work, portfolio projects, demonstrations, methodologies, sample outputs, or project-related material.
Where actual client or project work is shown, reasonable efforts will be made to describe the work accurately.
Unless clearly stated and supported:
- portfolio inclusion does not imply a particular revenue increase;
- it does not imply a particular ranking increase;
- it does not imply a particular conversion result;
- it does not imply that an AI platform recommended the client; and
- it does not imply an endorsement beyond what is expressly stated.
Demonstration or methodology material should not be interpreted as an actual client result unless identified as such.
31. Testimonials and Results
If testimonials, case studies, metrics, rankings, screenshots, or performance results are published in the future, they are intended to describe the relevant individual experience or documented result.
Past performance does not guarantee future performance.
Results vary according to the business, market, competition, implementation, timing, platform changes, and numerous external factors.
32. Accuracy of Site Content
Reasonable efforts are made to keep Site information useful and accurate.
However:
- digital platforms change;
- AI systems change;
- search algorithms change;
- prices may change;
- service availability may change;
- third-party information may become outdated; and
- errors may occasionally occur.
I may correct errors or update Site content without prior notice.
If you are making an important commercial decision, you should confirm the current information directly before relying on it.
33. No Warranty of Particular Results
To the fullest extent permitted by law, no representation or warranty is made that use of the Site, an audit, Site content, or general recommendations will produce a specific business result.
In particular, no warranty is made regarding:
- rankings;
- AI mentions;
- traffic;
- lead volume;
- enquiry volume;
- conversion rates;
- sales;
- revenue;
- profitability;
- customer acquisition costs; or
- business growth.
Any specific commitments made as part of a paid service will be governed by the applicable written service agreement.
34. Limitation of Liability for Website Use
To the fullest extent permitted by applicable law, Arunaksha Sarkar will not be liable for indirect, incidental, consequential, special, or purely speculative losses arising solely from:
- ordinary use of the free public Site;
- temporary Site unavailability;
- reliance on general informational content;
- third-party websites;
- third-party platform changes; or
- decisions made solely on the basis of illustrative or general Site materials.
This provision does not exclude or limit liability that cannot legally be excluded or limited.
Liability relating to paid professional services will be governed separately by the applicable Service Terms, proposal, service agreement, or other project-specific contract.
35. Your Statutory Rights
Nothing in these Terms is intended to exclude, restrict, or waive a right or remedy that cannot lawfully be excluded under applicable law.
Where you qualify as a consumer under applicable law, mandatory consumer-protection rights continue to apply.
If any provision of these Terms conflicts with a mandatory legal requirement, the mandatory requirement will prevail to the extent of that conflict.
36. Responsibility for Unlawful Misuse
To the extent permitted by applicable law, you may be responsible for losses or claims caused by your deliberate unlawful misuse of the Site, including:
- unauthorized access attempts;
- malicious attacks;
- intellectual-property infringement;
- fraudulent submissions;
- unlawful content; or
- impersonation.
Nothing in this section creates liability beyond what is permitted under applicable law.
37. Suspension or Restriction of Access
Access to the Site or particular functionality may be restricted where reasonably necessary to:
- protect Site security;
- prevent abuse;
- respond to spam;
- enforce rate limits;
- protect other visitors;
- comply with applicable law;
- respond to platform requirements; or
- investigate suspicious activity.
No person has an unconditional right to use interactive Site functionality.
38. Electronic Communications
You may communicate with me through channels such as:
- Site forms;
- WhatsApp;
- telephone;
- or other mutually agreed electronic methods.
Electronic communications can be used to discuss an enquiry or potential project.
However, informal discussions do not automatically modify an existing written service agreement.
Material changes to an accepted project should be clearly confirmed by both parties.
39. Service Communications
If you request an audit or enquire about services, I may contact you using the contact information you provided for purposes related to that request.
This may include:
- responding to your enquiry;
- discussing the audit;
- clarifying business information;
- discussing relevant services;
- arranging a call;
- sending a proposal; or
- following up reasonably on the request you initiated.
Submitting an audit does not automatically enroll you in unrelated bulk marketing communications.
40. Changes to These Terms
These Terms may be updated when necessary to reflect:
- changes in the Site;
- changes in services;
- changes in business operations;
- new technology;
- platform changes;
- changes in applicable law;
- or new functionality.
The Last Updated date at the top of this page will indicate the latest version.
Changes ordinarily apply from the date the updated Terms are posted.
Changes to these Site Terms will not retroactively rewrite an already accepted project agreement unless the parties separately agree or applicable law requires otherwise.
41. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a competent authority, that provision will be interpreted or limited to the extent necessary to make it enforceable where possible.
The remaining provisions will continue to apply to the extent permitted by law.
42. No Waiver
If I do not immediately enforce a provision of these Terms, that does not necessarily mean that the provision has been waived.
A waiver relating to one situation does not automatically apply to another situation.
43. Entire Terms for Website Use
These Terms, together with the Privacy Policy and other policies expressly incorporated into them, constitute the general terms governing use of the Site.
They do not replace a separate agreement governing paid professional services.
Paid engagements may additionally be governed by:
- Service Terms;
- Refund & Cancellation Policy;
- Disclaimer;
- proposal;
- Statement of Work;
- invoice terms;
- service agreement;
- confidentiality terms; or
- other written project-specific conditions.
44. Order of Priority for Paid Projects
If you become a paying client and there is a conflict between documents relating specifically to your project, the more specific written agreement will generally control the project.
Unless the applicable agreement states otherwise, a reasonable order of interpretation may be:
- signed or explicitly accepted project-specific Service Agreement / Statement of Work;
- accepted proposal or quotation;
- applicable Service Terms;
- Refund & Cancellation Policy;
- these general Website Terms;
- general descriptive website content.
Mandatory rights under applicable law continue to apply.
45. Governing Law
These Terms and use of the Site are governed by the laws of India, without excluding any mandatory legal protections that may apply to you.
